Family Law Mediation/Alternate Dispute Resolution

Frank Brinkman is a Registered Family Law Mediator. Family Law Mediation is a cost-effective means for resolving legal disputes that could otherwise lead to costly prolonged litigation. As a Registered Family Law Mediator, Frank’s more than 30 years of combined trial experience helps attorneys and parties explore alternatives to lengthy, emotional, and expensive litigation. The parties can save monies on attorney fees, appraisal fees, expert witness fees, and other substantial out-of-pocket expenses, while eliminating uncertainty about the outcome of their case. Mediation allows the parties to resolve their differences without engaging in lengthy, emotional, and expensive litigation.

Mediation is a process in which a neutral third person, called a Mediator, acts to encourage and to assist in the resolution of a dispute between two (2) or more parties. Mediation is an informal and non-adversarial process. The mediation objective is to help the disputing parties reach a mutually acceptable agreement between or among themselves on all or any part of the issues in dispute. Decision-making authority rests with the parties, not with the Mediator. The Mediator assists the parties in identifying issues, fostering joint problem-solving, exploring settlement alternatives, and in other ways consistent with these activities. 

You are in control of your case. During mediation you can negotiate an agreement which is creative AND which meets your needs. Remember, once your case goes to trial before a Judge, you lose complete control over the outcome of your case.

Mediation is empowering. Mediation helps you to create a workable and satisfactory agreement. Because you create the agreement, you have a vested interest in making the agreement work. Remember, it is YOUR agreement. 

Mediation saves you anguish. You don’t have to worry about protracted litigation. You don’t have to stay up all night worrying about your case. You can negotiate a settlement and bring your case to a quick closure. A mediated agreement allows you to go on with your life. 

Mediation is confidential. Mediation is a confidential proceeding. The Mediator is an impartial person who helps the parties negotiate their own agreement. Any family law matter can be mediated: divorce, paternity, child custody, child support, parenting time/visitation, property settlement, post Decree modification, and other family law issues. If mediation is not successful, you can still go to Court and let the Judge decide. 

Mediation is cost-efficient. Successful mediation saves the parties on attorney fees, appraisal expenses, expert witness fees, and litigation-related expenses. Parties can mediate their dispute without having to hire an attorney.

Indiana has formal Alternate Dispute Resolution ADR Rules.
